The Nominal Defendant

If you have been injured in circumstances where the vehicle who caused the accident is either uninsured or cannot be identified then you may still be able to make a claim. Within the Motor Accidents Authority is a department called the Nominal Defendant. This department will then receive the claim and refer it to one of the green slip insurers to act for the Nominal Defendant.
Once the claim has been accepted by the Nominal Defendant then the case runs the same as if the car did have insurance.
It is important that you make attempts to identify the vehicle if it is unidentified as you have an obligation under the Act to attempt to find the vehicle. The insurer will ask you to confirm what you have done to try and locate the vehicle.
